MURWALLS PRIZE DRAW TERMS AND CONDITIONS

 

By participating in the MurWalls “Snap a pic to win” prize draw, you fully agree and accept these Prize Draw Terms and Conditions

 

1.     Promoter

The promoter of this Prize Draw is MurWalls Ltd, a company registered in England and Wales with company registration number 12138054 and whose registered office is at Suite 204a, East Wing Sterling House, Langston Road, Loughton, Essex, England, IG10 3TS

2.     Eligibility

a. The Prize Draw is open to UK mainland entrants only.

b. You must be aged 18 or over by the Opening Date to participate. Proof of identity may be required. This must be provided on request.

c. Employees of MurWalls, their subsidiaries, partners, or their family members, or anyone else connected in any way with the Prize Draw, or helping to set up the Prize Draw, shall not be permitted to enter the Prize Draw.

d. To enter the Prize Draw, entrants must have access to the internet and have an Instagram account. All entries must be made directly by the person entering the Prize Draw.

By entering the Prize Draw you confirm that all information submitted by you is true, current and complete.

 

3.     Prize Draw Information, How to Enter and Selection Process

a. Entry is free but entrants should be aware that they may be subject to data charges depending on their own individual arrangements for internet access.

b. In order to enter the Prize Draw, entrants are required to upload a photograph infront of the MurWalls Care Bears™ window display at Irregular Choice, 35 Carnaby St, Carnaby, London W1F 7DP on Instagram, be following both @irregularchoice and @murwalls Instagram pages and to tag both@irregularchoice and @murwalls in the post. For every post, the entrant shall receive one entry to the Prize Draw.

c. The Prize Draw will be open from 11am BST on 11th September 2021. Closing date for entry will be at 11am BST on 25th September 2021. After the Closing Date no further entries to the Prize Draw will be permitted and any such entries received shall be automatically disqualified.

d. No responsibility is accepted for entries not received for whatever reason, including for entries lost, delayed or corrupted, or due to computer error.

e. Each entrant is entitled to multiple entries into the Prize Draw.

f. The winning entrant will be selected at random by MurWalls using a verifiable computerised system producing random results from all entries received by the closing date and in accordance with the Prize Draw T&Cs.

g. The winner will be notified by direct message through the Instagram account used to enter the Prize Draw. The winner will receive notification that it has won the Prize Draw within seven (7) working days of the closing date.

h. Within the direct message that MurWalls sends to the winner they will request the winner’s full name and email address. Once confirmation of acceptance of the prize, has been received from the winner and they have provided their full name and a valid email address, MurWalls may then request further information from the winner, such as their country of residence, postal address and proof of identity. MurWalls will then arrange delivery of the Prize.

i. Reasonable efforts will be made to contact the winner by MurWalls. If the winner cannot be contacted within seven (7) working days of the Prize Draw Closing Date or the winner fails to communicate their acceptance of the Prize by responding to MurWalls direct message and providing their email address, within seven (7) working days of being contacted by MurWalls or is unable to comply with these Prize Draw T&Cs, then MurWalls reserves the right to offer the Prize to the next eligible entrant drawn at random.

 

4.     Prize

a. The prize is: one (1) winner will receive one (1) Limited Edition 420x420mm Giclée Fine Art Care Bears™ (Cheer Bear) Art Print.

b. MurWalls will be responsible for coordinating and delivering the Prize to the chosen winner within eight (8) weeks of the winner being contacted by MurWalls.

c. The Prize can only be claimed and used at an address on the UK mainland, which is comprised of England, Scotland and Wales only.

d. The winner confirms that it will not utilise the Prize for commercial purposes (for example but not limited to, the Prize cannot be resold or auctioned).

e. The Prize is subject to these Prize Draw T&Cs, and any further regulations relating to the use of the Prize. By accepting the Prize, the winner agrees to comply with any and all applicable terms and conditions and regulations.

f. No cash alternative to the Prize will be offered. The Prize is non-­‐refundable and non-­‐transferable. MurWalls reserve the right to substitute the Prize with another of equivalent value without giving notice.

g. MurWalls reserve the right in its sole discretion to withhold delivery of the Prize until proof of eligibility and/or identity requested by the Promoters has been confirmed. If such proof is not produced on request, the Promoters may disqualify an entrant from the Prize Draw.

h. The winner is responsible for ensuring they are able to accept the Prize as set out and in accordance with these Prize Draw T&Cs. In the event they are unable to do so, then MurWalls reserves the right to redraw the winner of the Prize.

 

5.     Publicity and Use of Entry Materials

a. The winner may be asked to provide their consent to participate in reasonable publicity relating to this Prize Draw, including but not limited to having their name, photograph and disclosure of country of residence published with their entry and used for future promotional, marketing and publicity purposes in any media worldwide without notice or without any fee being paid and will co-­operate with any other reasonable requests by MurWalls relating to any post‐winning publicity. The winner has the right to withdraw their consent as provided at any time by speaking to a MurWalls DPO representative by emailing info@murwalls.com.

 

6.     Personal Data

a. By participating in the Prize Draw, you acknowledge that your Instagram username, name, e-­mail address and/or postal address will have been made available to MurWalls.

b. All Personal Data will be held and used by MurWalls in accordance with MurWalls Privacy Policy. We may also use the information you provide to verify your age and identity.

 

7.     General

a. This Prize Draw is in no way sponsored, endorsed or administered by, or associated with, Instagram. Instagram is fully released by the entrant from all liability that may arise from any matter related to the Prize Draw and Instagram may not be held liable for any claim arising from an entrant’s participation in the prize draw or taking up a Prize.

b. Any entrant must comply with any directions given to him or her by MurWalls including but not limited to any and all relevant laws, rules and regulations.

c. Any entrant who enters or attempts to enter the Prize Draw in a manner, which in MurWalls’ determination, is contrary to these Prize Draw T&Cs or is unfair, fraudulent or unjust to other entrants or is otherwise not in the spirit of the Prize Draw (including without limitation tampering with the operation of the Prize Draw, hacking, cheating, deception, or any other unfair playing practices such as intending to annoy, abuse, threaten, or harass any other entrants or MurWalls and/or any of its agents or representatives), may be rejected from the Prize Draw at MurWalls’ discretion.

d. MurWalls may cancel or amend the Prize Draw, the Prize or these Prize Draw T&Cs without prior notice and for any reason, including (without limitation) in the case of a manifest error. Any changes will be posted within these Prize Draw T&Cs.

e. MurWalls reserve the right to modify, cancel, terminate or suspend the Prize Draw in whole or in part, at their sole discretion, if they believe the Prize Draw is not capable of being conducted as specified in these Prize Draw T&Cs or in the event of system failure, maintenance or repair, network issue, a virus, computer bug or unauthorised human intervention or any other cause that is beyond the reasonable control of MurWalls that could corrupt or affect the administration, security, impartiality, or normal course of the Prize Draw, including, but not limited to the unavailability of the vote, poll, competition or Prize Draw entry platform before the Closing Date, or for strike, lock-­out, labour dispute, illness, act of God, natural disaster, adverse weather conditions, war, riot, civil commotion, accident, epidemic or pandemic, malicious damage, fire, flood and/or storm, compliance with law or governmental order, rule, regulation or direction, breakdown of plant, machinery or transportation. MurWalls are not responsible for any loss or damage caused to you as a result of any of these occurrences.

f. MurWalls will not be liable to you for any loss that is not foreseeable, and MurWalls exclude their liability to the maximum extent permitted by law. Nothing in these Prize Draw T&Cs shall limit or exclude liability for death or personal injury as a result of MurWalls’ negligence, fraud or fraudulent misrepresentation or for any other liability which may not be excluded by law.

g. You agree to reimburse MurWalls in respect of any damages suffered by MurWalls, or any losses by MurWalls resulting from any claim made by a third party in each case in respect of any matter arising from your entry to the Prize Draw, your use of the services relating to the Prize Draw in breach of the Prize Draw T&Cs or from your violating of any applicable law or regulation.

h. The invalidity or unenforceability of any provision of these Prize Draw T&Cs shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Prize Draw T&Cs shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

i. The Prize Draw and these Prize Draw T&Cs will be governed by English law and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
